TERMS AND CONDITIONS
CADBURY DAIRY MILK #Saythankyou CAMPAIGN
This #SAY THANK YOU campaign (hereinafter referred to as "Campaign") is launched by Mondelez India Foods Private Limited having its registered office at Unit No 2001, 20th Floor, Tower-3 Wing-C, One International Center, Parel, Mumbai- 400 013 (“Mondelez”). Please read these terms and conditions ("T&Cs") before participating in this Campaign.
Participation in this Campaign is voluntary. You agree that, if you chose to participate in this Campaign, you will be bound by these T&Cs and you acknowledge that you satisfy all Campaign eligibility requirements as provided herein below.
Mondelez has engaged with Jio Platforms Limited to organize and run the Campaign which shall be hosted on JioEngage platform on MyJio and Jio TV application (hereinafter referred to as “JioEngage”). Jio Platforms Limited and/or its affiliates shall also facilitate distribution of Prizes to the winners of the campaign as per terms and conditions stated herein (hereinafter referred to as “Campaign Partner”).
For the purposes of these T&Cs, wherever the context so requires "You" or "Your" shall mean any natural person who is a participant in the Campaign and "We" or "Our" or “Us” or “Mondelez” shall mean Mondelez India Foods Private Limited.
1.1. You need to fulfil the following eligibility criteria to participate in the Campaign:
(i) You need to be a natural person acting for purpose outside your business or profession, and citizen of India;
(ii) You should be an individual legal resident of the Republic of India;
(iii) You should be of an age 18 years or above at the time of entry into the Campaign;
(iv) You shall be legally competent to enter into binding contract under the applicable laws of India.
1.2. All who fulfils the eligibility criterial to participate in the Campaign shall individually referred to as “Participant” and collectively “Participants”.
1.3. Our / Campaign Partner’s employees, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and our affiliates, advisors, advertising/ Campaign agencies are not eligible to participate or avail any benefits under the Campaign.
2. DETAILS OF THE CAMPAIGN:
a. This Campaign will commence from 21st April 2021 and end at 11:59 PM on 30th May 2021 ("Campaign Period"). Any entries before or after the Campaign Period will not be considered. We reserve our right to cancel/modify/extend the Campaign Period or the T&Cs applicable to this Campaign as per our discretion and without giving any prior notice to You. No claims/questions shall be entertained in this regard. The campaign shall be available PAN India.
b. This campaign requires Participant to create and download/share a card, subject to the General Content Guidelines stipulated under Annexure III, which has names or names with images of people who the Participant wants to Say Thank You for standing behind them and making their lives easier. This can be done through a smart newsfeed app hosted on the official Facebook page or on JioEngage or on www.cadburysaythankyou.com. Participant needs to upload up to 3 names with or without images with the people they want to thank. The created card needs to be shared on social media pages by using #SayThankYou and tagging the official Cadbury Dairy Milk Facebook page (https://www.facebook.com/cadburydairymilkindia) / Instagram handle (https://www.instagram.com/cadburydairymilkin) / Twitter handle (https://twitter.com/DairyMilkIn) (collectively “Social Media Page”), along with #SayThankYou to be eligible for the winning the Prize in the Campaign.
c. You must follow the following steps to participate in the Campaign
c.i. If you wish to participate in the Campaign through JioEngage, and you do not have the MyJio/Jio TV app installed on your phone, you will have to download it from the Android Play Store/ Apple Store, as applicable and data charges and expenses of the same will be borne by the user. You need to register on MyJio / Jio TV App using appropriate login credentials supported by such applications.
c.ii. If you have seen the notifications/ advertisement or otherwise come across the Campaign banner on MyJio/Jio TV or through Social Media Page, you are required to click on the banner which will lead to the campaign loading page on MyJio/Jio TV or News Feed of Social Media Page. Accept the T&C’s to participate and move ahead in the Campaign.
c.iii. You can also click on Jio Cricket Play Along banner (JCPA) inside JioEngage on MyJio / Jio TV, accept the T&Cs and click on ‘SayThankYou’ banner inside JCPA. Alternatively, you can go to www.cadburysaythankyou.com to participate.
c.iv. You will then see a polaroid card and three “+” buttons. Click on the “+” buttons to add upto three users whom you want to Thank.
In this activity, users need to either (a) Click a picture or (b) Upload a picture of the person whom they want to Thank. Additionally they need to add their names and how these people have helped them (the options are available in the drop down). Adding a picture is optional. However, if you are using the picture to participate in the Campaign, You agree and give your confirmation that you have obtained consent from the people you thank or confirm they have/would have no objection for using their name and image in the card created on JioEngage/Newsfeed app/www.cadburysaythankyou.com for the purpose of participation in this Campaign. Mondelez is not responsible and it disclaims any liability, directly or indirectly in this regard.
Upon submission of all these information a Thank you card gets created. The user then needs to either (i) download the card on his / her device and / or (ii) share these cards to become eligible for Prize(s).
Rules for uploading pictures:
c.iv..a. A Participant may either click a picture or select the picture from his / her device to upload and participate in the campaign. A Participant may also delete the picture after upload by clicking on the ‘Delete’ / ‘Bin’ icon.
c.iv..b. For a Participant who is below the age of 18 years, the submission of picture either by parents or guardian or by the Participant with the permission of parents or guardian to the Campaign will be deemed as the Participant’s consent to participate.
c.iv..c. A Participant may submit upto three picture on a single entry for Thank you card. However, a Participant may submit multiple entries for this Campaign.
c.iv..d. Mondelez may, in its sole discretion decide to consider any criteria including but not limited to (i) adherence to Thank you theme; (ii) picture quality and clarity (iii) aesthetic value to select a picture to be published on Cadbury Dairy Milk Social page.
c.iv..e. Mondelez reserves the right to disqualify and take down any entries that it deems in its sole discretion to be offensive, distasteful, unacceptable or against its ethos or principles or which may be disparaging.
c.iv..f. The activity aims to acknowledge the unacknowledged by saying Thank You.
d. Any and all grievances, suggestions and/or concerns with regards to the conduct, or any other activity in relation to the Campaign, can be directed towards Mondelez at 1800227080 or firstname.lastname@example.org not later than 14 days from the expiry of the Campaign Period. All grievances pertaining to distribution of the ‘Data Prizes (hereinafter defined below) can be directed towards Campaign Partner at 18008899999 not later than 14 days from the expiry of the Campaign Period. Failure to do so would tantamount to the expiry of any claims in connection with the Campaign submitted by a person. It shall not be open for the Participant to require audit or verification of the information, data or any other criteria, process or system adopted by Mondelēz or Campaign Partner.
e. Entries through JioEngage on MyJio / Jio TV App:
(i) Campaign Partner shall furnish to Mondelez, data provided by the Participants, relevant only to the entry submitted by the Participant including personal information such as mobile number, and the Participant hereby expressly consents to the sharing of any such data to Mondelez.
(ii) All attempts will be made by Campaign Partner to protect the data submitted to it by a Participant from loss and corruption, but in the event such data loss happens, Campaign Partner may have to continue with whatever data is available, or in any other manner as it may deem reasonable. Mondelez and Campaign Partner should not be held responsible for any loss of data or the action taken on account of the same. Mondelez and Campaign Partner and/or its affiliates will not be held responsible to make good any such loss or dissatisfaction on account of such loss.
(iii) Campaign Partner will take reasonable efforts to ensure that there is no security breach at its end in the course of conduct of submission of entry for the Campaign and/or that there is no data / entry loss and/or any other loss at its end. However, in the event of a security breach and/or data/ entry loss and/or any other loss for any reasons whatsoever, Mondelez and Campaign Partner and/or its affiliates will not be responsible or liable in any manner whatsoever for any loss on account of any such instances as may be sustained by the Participant. Mondelez and Campaign Partner shall have the right at all times to exclude or disregard any entries submitted during any period where a security breach or data/entry loss or any other loss occurs.
(iv) Participant acknowledges that all possible issues may not have been identified by Campaign Partner and/or its affiliates and associates and/or JioEngage and agrees to hold harmless Mondelez and Campaign Partner and/or its affiliates and associates and/or JioEngage for the application, network, process, technical or any other failures.
2 PRIZES AND WINNER SELECTION:
Mondelez reserves right to add or modify (i) Type and count of Prizes available; (ii) Eligibility criteria for qualifying and winning Prizes; (iii) Count of Winners (hereinafter defined); (iv) Special Terms and Conditions (hereinafter defined); or (v) Any other aspect related to Prizes and Winner selection. Subject to aforementioned, below are the Prizes available on offer during the Campaign Period:
a. ‘Additional 250 MB Data Voucher’ (“Data Prize”) on successfully downloading or sharing the card for participants participating through JioEngage:
(a.i) “Additional 250 MB Data Voucher(s)” shall mean additional data packs of RJIL.
(a.ii) During the Campaign Period, Participant(s) who have (i) successfully created the card, (ii) clicked on ‘Download’ button to download the card on their device or clicked on ‘Share’ button to share such card using native sharing apps available on their device and (iii) accepted T&C’s shall be eligible to win Additional Data Voucher(s) of RJIL (“Eligible Data Participants”).
(a.iii) Each day up to 5000 Eligible Data Participant(s) will be determined as “Data Prize Winner(s)” on first come first serve basis and awarded Additional 250 MB Data Voucher. Mondelez reserves the right to determine any number of Eligible Data Participant(s) as “Data Prize Winner(s)” at its sole discretion without any prior intimation. Any Data Prize not exhausted during a particular day during the Campaign Period shall be carried forwarded to the subsequent days at the sole discretion of Mondelez.
(a.iv) A Participant can submit multiple entries during the Campaign Period through JioEngage, however each Participant will be eligible to win Data Prize, only once during the Campaign Period.
(a.v) Additional 250 MB Data Voucher won will get reflected in “My Winnings” tab under ‘Prizes’ section of the Campaign. However, such Additional Data Voucher will be credited to the account to Data Prize Winner only if such Data Prize Winner is an active subscriber of telecommunication services of RJIL on the day of credit and has used such registered mobile number of RJIL to participate in the Campaign.
(a.vi) The validity of the Data Prizes is as per the usual validity defined by Reliance Jio Infocomm Limited (“RJIL”) and Mondelez will not play any role of getting the same extended or amended as per request from the consumer.
(a.vii) Special Terms and Conditions applicable for Additional 250 MB Data Voucher are given in Annexure 1.
b. Personalised Signed Merchandise by Mumbai Indians (“Merchadise Prize”) on successfully sharing the card on Social Media Pages by tagging Cadbury Dairy Milk and #SayThankYou for all participants participating through Facebook, JioEngage and/or Cadbury Website (www.cadburysaythankyou.com):
(b.i) Merchandise Prize shall mean a personalised Mumbai Indians’ hamper comprising of a signed jersey by players & Cadbury Dairy Milk chocolates.
(b.ii) During the Campaign Period, Participant(s) who have (i) successfully created the card, (ii) shared such card on Social Media Pages by tagging the Cadbury Dairy Milk and #SayThankYou and (iii) accepted T&C’s shall be eligible to win Merchandise Prize for the people they have thanked (“Eligible Merchandise Prize Participants”).
(b.iii) Participants having the ten best #SayThankYou Card based on merit during the Campaign Period will be selected from the list of Eligible Merchandise Prize Participants who will be awarded with the Merchandise Prize for the people they have thanked (“Merchandise Prize Winner”) subject to successful verification as mentioned hereinafter below.
(b.iv) An Eligible Merchandise Prize Participant can win only 1 Merchandise Prize and only once during the Campaign Period, for the person(s) he/she has thanked.
(b.v) The Merchandise Prize as mentioned above will be sent across to the individual address shared by the Merchandise Prize Winner posting the card within 15 business days of communication of the personal details Participant who has won the Campaign. Any issue or delay in delivery will be notified to the Merchandise Prize Winner.
(b.vi) The Merchandise Prize Winners will be announced on our Social Media Pages and will be contacted through replies and direct messages on Facebook/Instagram/Twitter to share their Email IDs, contact no. and other details for purpose of Prize disbursement. If the Merchandise Prize Winner does not respond to communications within 1 day of initial contact, Mondelez reserves the right to disqualify that Merchandise Prize Winner and to re-allocate that Merchandise Prize.
(a.vi) Merchandise Prize Winners will be required to respond to confirm eligibility and share personal photo ID to confirm their identity over photographs through the Social Media Page in private. This data is only for confirmation of the entry by the actual person and will not be used for any other purposes. In the event that the selected Participant does not respond to communications within 1 day of initial contact, Mondelez reserves the right to disqualify that Merchandise Prize Winner and to re-allocate that Prize. Merchandise Prize Winners will be required to share the verification documents as provided below:
Copy / Image of Valid Photo ID proof such as Driving License or PASSPORT or Voter ID Card or PAN Card as proof for identification and verification purpose only.
( vii) For Merchandise Prize winners Mondelez may, at its discretion, decide to publish such selected pictures for which the Merchanise Prize has been won on its social media websites, handles, pages etc. owned by the Mondelez..
DELIVERY OF MERCHANDISE PRIZES:
(i) The Merchandise Prize will be delivered within 15 business days after the details for delivery of such Merchandise Prize is confirmed by the Merchandise Prize Winner. For the avoidance of doubt, due to lockdown restrictions imposed by government authorities or for any other force majeure event because of which we are not able to deliver the Merchandise Prize within the above-mentioned period, we shall communicate to you.
(ii) Any complaints regarding the non-delivery of the Merchandise Prize should be made within 7 days of intimation of the date of dispatch (intimated through E-mail/SMS mentioned in clause 2(d)) of the Merchandise Prize . The winner will get an intimation via Email/SMS on the dispatch within 10 business days of the booking. Winner can also go and pick up the Merchandise Prizefrom the local depot of the courier company.
(iii) Mondelez and/or its authorised service partner will attempt the delivery of the Merchandise Prize twice to the address provided by Merchandise Prize Winner, if at the first instance the courier company couldn’t deliver the Merchandise Prize for various of reasons such as (not limiting to) not at home, phone switched off, change of delivery address, wrong address etc. If the Merchandise Prize is still returned, Mondelez and/or its authorised service partner will not be liable to dispatch the Merchandise Prizeagain.
(iv) Merchandise Prize once delivered cannot be replaced under any circumstances;
3. ADDITIONAL TERMS:
3.1 Mondelez may, at our sole discretion, change the T&Cs or cancel the Campaign at any time; or modify, terminate, or suspend the Campaign including for reasons such as should viruses, worms, bugs, unauthorized human intervention or other causes beyond our control that corrupt or impair the administration, security, fairness or proper play of the Campaign or submission of entries.
3.2 Mondelez and Campaign Partner will not be responsible for: (a) any SPAM generated messages; (b) any SMS message delivery failures; (c) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by You or by any of the equipment or programming associated with or utilized in the Campaign, or by any technical or human error that may occur in the processing of entries; (d) any printing or typographical errors in any materials associated with the Campaign; (e) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the internet or at Campaign Partner or Mondelez website; (f) injury or damage to Your or any other computer or mobile resulting from downloading any materials in connection with the Campaign; (g) other conditions beyond Our reasonable control.
3.3 We, in our sole discretion reserves our right to exclude You from Campaign and/or not to attribute the Prize, and/or to cancel all or part of the Campaign, without any liability on our part, if We believe You have (a) breached any of these T&Cs; (b) acted or have the intention of act in a dishonest or fraudulent manner, or in bad faith; (c) tampered with the entry process or the operation of the Campaign; (d) acted in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.
3.4 If Your entry is incomplete or if You use robotic, automatic, programmed or similar entry methods, your entry will be void. The authorized subscriber of the MyJio / Jio TV account used to enter the Campaign at the actual time of entry will be deemed to be the Participant and must comply with these T&Cs in the event of a dispute as to entries submitted by multiple users having the same MyJio / Jio TV account. The authorized account subscriber is the natural person has successfully signed in to their MyJio / Jio TV application account. No benefits greater than those described in the "Details of the Campaign" section given in this T&Cs will be awarded.
3.5 The Prizes will be provided on an “as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and the Campaign Partner, Mondelez, their associates, affiliates, directors, officers, agents, representatives shall not be responsible or liable for including but not limited to the prizes, product and service liabilities and any claim in this regard.
3.6 The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the Winner does not avail the Prize in the time and manner stipulated, then the Prize will be forfeited. Prize must be availed as mentioned in the terms and conditions and cannot be varied.
4.1 Participation in this Campaign is at your sole discretion and on a voluntary basis.
4.2 You agree that all decisions taken by Mondelez or Campaign Partner related to the Campaign is final and binding on You. Failure by Campaign Partner to enforce any of these T&Cs in any instance shall not be deemed to be a waiver of the T&Cs and shall not give rise to any claim by any person.
4.3 We will not be liable for any costs incurred by You in connection with Your participation in the Campaign.
4.4 Announcements and information about the Campaign shall be posted on JioEngage tab under MyJio / Jio TV – Please refer to the T&Cs section and My Winnings for any details or visit www.cadburysaythankyou.com.
4.5 If you are dissatisfied with the Campaign or the Campaign rules and/or any content or any requirements of the Campaign form, the materials available related thereto, or with these T&Cs, his/her sole and exclusive remedy is to not participate in the Campaign.
4.6 If a person chooses to access this Campaign from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.
4.7 Prizes are provided on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and Mondelez and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or be liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any Prize or for any kind of consequential damages/ loss, in any manner whatsoever.
4.8 Mondelēz or Campaign Partner accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. Mondelēz or Campaign Partner shall not be liable for any consequences of user error including (without limitation) costs incurred.
4.9 In the event of death of Winner, no nominees or heirs or any other person shall be eligible to the Prize and no claim from the nominee or his/her legal heirs of the Winner or any other person shall be entertained for receiving the Prize.
4.10 All applicable taxes resulting from acceptance of Prize(s) shall be the responsibility of Winners.
5. INTELLECTUAL PROPERTY RIGHTS:
5.1 All right, title and interest, including but not limited to the intellectual property rights, in the promotional material(s) and all Campaign related material shall vest solely and exclusively with Mondelez at all times. Mondelez or any person or entity permitted by Mondelez in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
5.2 All material submitted in connection with the Campaign (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Mondelez upon submission and become the property of Mondelez and Campaign Partner exclusively. Mondelez may use the material in any medium in any reasonable manner it deems fit in connection with the Campaign. All intellectual property, including without limitation, any copyrights, trademarks, designs and know how (“Intellectual Property”) relating to Mondelez products shall belong to Mondelez. All Intellectual Property related to the Campaign, JioEngage and/or MyJio and/or Jio TV and those owned exclusively by the Campaign Partner shall at all times continue to belong to the Campaign Partner.
6. PERSONAL INFORMATION:
6.1 You agree that for the purpose of operating this Campaign, Campaign Partner and Mondelez may collect personal and/or sensitive personal information (“Personal Data”) from You. Such Personal Data can be shared with and used by Mondelēz and/or the Campaign Partner for the purpose of operating this Campaign. Providing Personal Information is voluntary; however, failure to provide such data shall result in your inability to participate in the Campaign. Participants eligible for a Prize give their consent to the collection and processing of such Personal Information. Please note that your acceptance of these terms and conditions is deemed to signify your agreement to the Privacy Notice as well and the necessary consent to what we might do with your Personal Data as described in the Privacy Notice. In addition to the privacy terms under this clause, Participants who choose to participate via the MyJio / Jio TV App, will be subject to the MyJio / Jio TV App privacy terms by virtue of using that platform.
6.2 We reserve the right to refuse to issue Prizes to the winners unless they provide their Personal Data including location access to MyJio / Jio TV App necessary to release the Prize and to perform other activities to run the Campaign.
6.3 Participants authorize Campaign Partner to use the Personal Data sent to the Campaign in connection with the Campaign.
6.4 By accepting these terms and conditions you also hereby give your consent to Mondelez or any other third party nominated by Mondelez to carry out profiling of your anonymized data made available through JioEngage and/or MyJio and/or Jio TV and for this reason transfer of your Personal Data to such third parties. Mondelēz and/or Campaign Partner will take the necessary measures to secure and keep safe, either directly or through third parties, any such information that You may have shared. In case of any grievance relating to storage of your Personal Data you may report the same by using any of the modes of raising complaints as provided on JioEngage and/or MyJio and/or Jio TV.
6.5 It is important to remember that whatever You transmit or disclose can be collected and used by others or unlawfully intercepted by third-parties. No data transmission can be guaranteed to be 100% secure. While We strive to use commercially reasonable means to protect Your information, We cannot warrant the security of any information You transmit to us.
6.6 Your personal information may be retained and may continue to be used until: (i) the relevant purposes for the use of Your information described in this clause are no longer applicable; and (ii) We and/or Campaign Partners are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain Your personal information and the retention of Your personal information is not required for the establishment, exercise or defence of any legal claim.
7. FORCE MAJEURE:
This Campaign is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of Mondelēz or Campaign Partner ("Force Majeure Event"). We or Campaign Partner shall not be liable for any delay or adverse effect caused to the participants in the Campaign including the winners as a result of a Force Majeure Event.
8. GOVERNING LAW AND JURISDICTION:
The courts of competent jurisdiction at Mumbai shall have sole and exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Campaign. Participation in the Campaign is unauthorized in any jurisdiction that does not give effect to all provisions of these T&Cs, including (without limitation) this clause.
Further all issues and questions concerning the construction, validity, interpretation and enforceability of these T&Cs, or the rights and obligations of the participants and/or Mondelez and/or Campaign Partner, shall be governed and construed in accordance with the laws of the Republic of India.
9. PUBLICITY RELEASE:
By participating in the Campaign, you give Mondelēz and/ or its affiliates permission to use your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the Campaign and any promotions, events, or Campaigns to follow. You agree that and Mondelez or its affiliates have the right to publish your saved item details for any communication, promotions, events, or Campaigns that follow. You agree that Mondelez and/ or its affiliates have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, a materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation, etc. for the use of such pictures, etc., and hereby release Mondelez and/ or its affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use. You give your consent to Mondelez and/or its affiliates, agents and assigns to use your name and likeness to promote the Campaign and any promotions, events, or Campaigns to follow. Notwithstanding the foregoing, the Participants shall not upload any content which may be (i) obscene; or (ii) obnoxious; or (iii) vulgar; or (iv) offensive to any group, sect or denomination of persons; or (iv) which may, in any manner, be construed as harmful or inciteful, in any manner whatsoever. Participants uploading any such content shall be disqualified from the Campaign immediately and shall not be eligible to receive any Prizes, if won.
10. LIABILITY RELEASE:
This Campaign is being made purely on a "best effort" basis and participating in this Campaign is voluntary. By participating in the Campaign, you will be legally bound hereby, to release from liability, and hold harmless Mondelez or Campaign Partner and any of its / their affiliates, employees or agents representing or related to Mondelez or Campaign Partner and its / their services/products for any matters in relation to this Campaign, including the Prizes. This release is for any and all liability for personal injuries (including death), property loss or damage, and misuse of the benefits/ Prizes offered under this Campaign, in connection with any activity or directly or indirectly, by reason of the acceptance, possession, or participation in the Campaign, even if caused or contributed to by our negligence. By participating in this Campaign, you agree to indemnify and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the Prize or participation in the Campaign including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise. You shall be liable for all the personal taxation that might arise out of the winnings from this Campaign and shall not hold Mondelez or Campaign Partner and/ or its affiliates responsible for payment of the same and/ or any dispute arising in relation thereof.
Mondelez is the Sponsor for the Prizes. The Campaign shall be operated by the Campaign Partner which includes maintenance of the platform, receiving entries, declaring winners and ensuring delivery of Prizes except Personalized Signed Merchandise stipulated in clause 2(c) above.
Special Terms and Conditions for Additional 250 MB Data Voucher
1. Additional 250 MB Data Voucher shall mean Jio data voucher of 250 MB.
2. Additional 250 MB Data Voucher will get reflected in “My Winnings” tab under ‘Engage’ tab of “MyJio/Jio TV” and will be credited to the registered mobile number of RJIL used to participate within 7 days from the date it gets reflected in “My Winnings” tab.
3. The Offer shall be open for all Eligible Customers on and from the start of the Campaign Period.
4. Additional 250 MB Data Voucher is credited only if such registered mobile number has an active Base Plan / MRP Plan with a validity period. “Base Plan” / “MRP Plan” shall mean the current subscription plan of RJIL used by the Participant in the process of participating in this Campaign.
5. Where any applicable Additional 250 MB Data Voucher is credited during a Recharge Cycle period (“Recharge Cycle Period” shall mean the validity period of a Base Plan, starting from the date of activation of RJIL SIM, and subsequent periods of active date base plan), the benefits attached to such Voucher shall be limited to that Recharge Cycle period and any such benefits that remain unutilized at end of that Recharge Cycle period, will expire and be forfeited.
6. Additional 250 MB Data Voucher(s) is not transferable, nor can it be exchanged nor can it be varied and no cash payment in lieu of the same will be made. Company shall not be held liable for the failure of a Participant to utilize their Additional 250 MB Data Voucher.

A. What Personal data do we collect from you?
The type of information and Personal Data that we collect about you when you visit our Sites or interact with us may include the following:
Personal details provided by you – such as but not limited to your name, age, gender, postal address and other contact details, such as your telephone number and email address, your requests, any complaints you may have and any other data we receive if you communicate with us via email, online or via social media, when you navigate our Sites and any other information you provide – for example, when you register with our Sites, sign up for our newsletters, participate in our offers and promotions, provide customer feedback, reply to surveys or purchase our products or services;

B. Why do we Process your Personal Data?
We Process your Personal Data for the purposes below and on any other lawful basis. Please know that insofar we already hold information about you, we may Process that information for the same purposes.
For legitimate commercial interests: we may Process your Personal Data (both on an aggregated and on an individual basis), for the purpose of advertising, marketing, running schemes and campaigns, conducting research or surveys, providing, personalising, measuring, improving and promoting our products and services, providing, understanding, improving, customizing and developing our Sites, creation and maintenance of a trusted and safe environment on Sites (such as complying with our legal obligations and compliance with our policies), profiling, making payments or for recording financial transactions and for analysing and improving the quality of our products or services, as well as, to understand you as a customer.

We may also Process your information, where granted, for instance for marketing purposes and for tailoring our communications with you based on your profiles via email, SMS, other electronic means or otherwise. To comply with our legal obligations, such as maintaining appropriate business records, handling complaints made to our customer service, managing product health, safety or quality complaints, complying with lawful requests by public authorities and with applicable laws and regulations or as otherwise required by law.
C. How long do we retain your Personal Data?
We will only retain your Personal Data for as long as it is necessary to satisfy the purpose for which it was provided by you or collected by us (for example, for the time necessary for us to answer queries or resolve problems).
We may therefore retain your Personal Data for a reasonable period after your last interaction with us. When the Personal Data that we collect is no longer required in this way, we destroy or delete it in a secure manner. We may, instead of destroying or erasing your Personal Data, make it anonymous so that it cannot be associated with or tracked back to you. Service Providers and Processors. We may engage third party vendors, agents, service providers, and affiliated entities to provide services to us on our behalf, such as support for the internal operations of our websites, Mobile Apps or online stores (including social media services providers, payment Processors, brand activation agencies, data analytics providers and third parties we use for sending your orders to your address, such as postal courier vendors) or for the technical Processing (for example, hosting services or data storage) or for customer relationship management services, as well as related offline product or promotional support services, (for example, competitions, sweepstakes and contests organizers, winner draws providers, events management agencies, prize or compensation packages vendors), for profiling purposes to understand customer behaviours and patterns and, other related services. In providing their services, they may access, receive, maintain or otherwise Process Personal Data on our behalf. Our contracts with these service providers do not permit use of your information for their own purposes, including their marketing purposes. Consistent with applicable legal requirements, we take commercially reasonable steps to require third parties to adequately safeguard your Personal Data and only Process it in accordance with our instructions.

I. How do we Process Children’s Personal Data?
In general terms, our Sites are not intended to persons under 18 years old as under law they are deemed to be in a capacity to provide valid consent Any time persons under the said age access the Site, should provide a parent/guardian’s consent before providing any Personal Data to us to the website. If we determine upon collection that a user is underage and has not provided a parent/guardian’s consent before providing any Personal Data, we will not use or maintain his/her Personal Data without the parent/guardian’s consent. Without such consent, though, the relevant person under the age may not be able to participate in certain activities. General Content Guidelines
1. Offensive Material:
1.1. The content created and uploaded by the Participant for the Campaign (“Content”) must not contain content about race, ethnicity, religion, belief, age, sexual orientation or behavior, gender, disability, health condition (including physical and mental), economic status, criminal record, political bias and content that advocates violence;
1.2. The Content must not be of such nature that is likely to hurt the religious sentiments of any class of people, or which may be disparaging to any cast, creed, color, nationality or race.
2. Obscenity / Vulgar Content:
2.1. The Content should be compliant with The Information Technology Act, 2000, Indecent Representation of Women (Prohibition) Act, 1986 and the Indian Penal Code, 1906 which prohibit advertisements pertaining to obscenity in India. Content should not contain any content which is obscene, vulgar or which amounts to indecent representation of women.
2.2. The Content should not contain profane language or words or promote the sale of any obscene products.
2.3. The Content must not contain obscene, sexually provocative, sexually suggestive information. Content must not contain information that possibly lead to misconduct or dangerous behaviour.
3. The Participant shall not place any Content on the platform that infringe any third party rights including intellectual property rights, privacy rights, performer’s rights etc.
4. The Participant acknowledges that JioEngage is an intermediary under the Information Technology Act, 2000, as amended and the relevant rules made thereunder, with respect to the Content. JioEnage does not, and cannot review the Content provided by the Participant. As an intermediary, on receipt of a complaint from third parties that any Content allegedly violates any third party rights or any restrictions stated in this T&Cs, the Campaign Partner may remove or disable access to any such Content, with or without prior notice to the Participant.
5. The Participant shall at all times comply with all applicable laws, ordinances, regulations, and codes which are applicable to their participation in the Campaign.
